DestacarmeConIA is a SaaS (Software-as-a-Service) platform that uses artificial-intelligence technology to assist users with:

  • Generating personalized résumés (CVs)
  • Creating cover letters
  • Improvement recommendations for existing CVs
  • Professional development and training suggestions

The service is provided from Guatemala and is subject to Guatemalan law and the regulations applicable in Latin America.

3. CONTRACT FORMATION

By registering for our service, you enter into a legally binding contract with Koalit Solutions, S.A. under Guatemalan law. The contract is formed when we confirm your registration via a confirmation email.

4. USER ACCOUNT AND DATA PROTECTION

To use DestacarmeConIA you must create an account and provide accurate, complete information. You are responsible for keeping your account and password confidential.

Personal Data Protection:

  • We comply with applicable data-protection laws in Guatemala and Latin America.
  • Your personal data will be processed in accordance with our Privacy Policy.
  • We do not share your personal information with third parties without your express consent.
  • You have the right to access, rectify, and delete your personal data.

5. PRICING AND PAYMENT TERMS

Prices are shown in USD. All prices include applicable taxes under local legislation. Service fees are billed monthly.

Payment Terms:

  • Your subscription renews automatically each month unless cancelled at least one day before the renewal date.
  • Displayed prices may be converted to your local currency at current exchange rates.
  • The final charge may vary slightly due to exchange-rate fluctuations.
  • Local taxes will apply according to each country’s regulations.

Refunds:

  • Refund requests must be made within the first 7 days of the billing period.
  • Refunds are evaluated on a case-by-case basis.
  • No refunds are granted for services already used or consumed.

6. SERVICE USE AND LIMITATIONS

DestacarmeConIA provides AI-assisted professional-content generation services. Users acknowledge and agree to the following terms of use:

Service Purpose:

  • The service is provided for example and learning purposes only.
  • AI-generated CVs, cover letters, and recommendations are intended as templates and examples.
  • Users are STRONGLY ADVISED NOT to use AI-generated content directly without substantial personal review and modification.

Usage Restrictions:

  • We reserve the right to limit, suspend, or terminate service access at our discretion if we detect abuse or violation of these terms.
  • Users are responsible for keeping their account credentials confidential.
  • Account sharing among multiple users is prohibited.
  • Commercial use of the templates is not allowed without express authorization.
  • Use of the service for illegal or fraudulent activities is prohibited.

7. DISCLAIMER OF LIABILITY

To the maximum extent permitted by applicable law:

Service Limitations:

  • Content generated through our service is provided “AS IS” and “AS AVAILABLE” without express or implied warranties.
  • We expressly disclaim any liability for the content, accuracy, or suitability of generated material for any specific purpose.
  • Users assume full responsibility for any use, modification, or submission of generated content in job applications or other professional contexts.

Exclusion of Liabilities: We are not liable for any consequences, direct or indirect, arising from use of our service, including but not limited to:

  • Lost job opportunities
  • Rejected applications
  • Impact on professional reputation
  • Loss of potential income
  • Any misrepresentation in generated content
  • Technical errors or service interruptions
  • Data loss or security breaches

Important Warnings:

  • Although we strive for high accuracy and quality, AI-generated content may contain errors, inconsistencies, or inappropriate material.
  • Users are strongly advised to thoroughly review and modify all generated content before use.
  • We do not guarantee that our service will meet your specific requirements or expectations.
  • Our total liability, if any, will not exceed the amount you paid for the service in the month preceding the incident.

8. INTELLECTUAL PROPERTY

  • The service, including all software, algorithms, and interface designs, remains the exclusive property of Koalit Solutions, S.A.
  • While users retain rights to their personal information and modified content, AI-generated templates are provided under a limited, non-exclusive license for personal use only.
  • Users may not reproduce, distribute, or commercialize the service or its outputs without explicit written permission.

9. SECURITY AND PAYMENTS

DestacarmeConIA does not process payments directly on the website. All payments are securely processed through Recurrente, a third-party online payment provider.

Payment Security:

  • Your payment information is never stored on our servers.
  • All payment transactions are encrypted and securely processed by Recurrente.
  • Recurrente meets the highest security standards for payment processing.

10. DISPUTE RESOLUTION

Jurisdiction and Applicable Law:

  • These Terms are governed by the laws of Guatemala.
  • Any dispute will be resolved in the competent courts of Guatemala.
  • For users in other Latin American countries, local consumer-protection laws also apply where appropriate.

Amicable Resolution:

  • Before initiating any legal proceedings, the parties agree to attempt to resolve disputes through direct negotiation.
  • Negotiation period: 30 calendar days from notice of the dispute.

11. CANCELLATION AND TERMINATION

By the User:

  • You may cancel your subscription at any time from your dashboard.
  • Cancellation takes effect at the end of the current billing period.
  • No prorated refunds are given for unused periods.

By the Company:

  • We may terminate or suspend your account immediately if you violate these terms.
  • We reserve the right to discontinue the service with 30 days’ prior notice.

12. CHANGES TO THE TERMS

We reserve the right to modify these terms at any time. Changes take effect immediately upon publication on the website. Your continued use of the service after such changes constitutes acceptance of the new terms.

13. GENERAL PROVISIONS

Severability:
If any provision of these terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.

Entire Agreement:
These terms constitute the entire agreement between you and Koalit Solutions, S.A. regarding use of the service.
